The AIIB Special Appeals Tribunal is an independent administrative tribunal established by the Directive on the AIIB Special Appeals Tribunal, pursuant to Article 13(4) of AIIB’s Staff Regulations.
The Tribunal has jurisdiction over:
(a) all appeals filed against an Administrative Review Decision by the President under Staff Rule 8.01;
(b) any other matter referred to it by the Bank or to which the Bank poses no jurisdictional objection.
The Tribunal may affirm, reverse or modify the Administrative Review Decision appealed. In terms of relief, it may order rescission, specific performance or compensation. Judgments rendered by the Tribunal are final and binding upon the parties.
Composition of the Tribunal
The Special Appeals Tribunal functions in case-specific chambers constituted by three judges designated from the Panel of Independent Reviewers established and maintained under AIIB’s Staff Rule 8.01. Judges are drawn exclusively from Panel members who have not served as Independent Reviewer in any Administrative Review under Staff Rule 8.01.
The Tribunal is supported by a Secretariat, which is headed by an Executive Secretary who reports directly to the judges. The biographies of current members of the Panel of Independent Reviewers and the Executive Secretary of the Tribunal are as follows.
